TERMS OF SERVICE

1. ORDER PROCESS & DEADLINES

✦ Workflow Order:
Concept Discussion ⭢ References & Details ⭢ Payment ⭢ Work Begins.


✦ The Deadline:
The standard turnaround time is 14 calendar days (2 weeks).


✦ Countdown:
The deadline starts ticking only after I receive the full payment (or the first 50% milestone), along with all required references, character sheets, and project descriptions.


✦ Rush Orders:
If you need the artwork completed within 3–4 days, +100% rush fee will be applied to the total price.

2. PAYMENT & REFUND POLICY

✦ Payment Methods:
Crypto or PayPal. By paying the invoice, the Client automatically agrees to these Terms of Service. All transactions are for digital, non-physical services. The Client acknowledges that no physical items will be shipped and waives the right to open a dispute or chargeback claim once work has commenced.


✦ Payment Plan:
100% full prepayment is required before I start working. A 50/50 split payment can be negotiated only for large orders exceeding $200.


✦ Cancellation & Refunds:
All refund percentages are calculated from the TOTAL price of the commission, not the amount currently paid. (For 50/50 split payments)


- 50% refund if you cancel during the sketch stage.
- 0% refund once the sketch is officially approved and I move to the lining/coloring/rendering stages.


If I am unable to complete your order due to personal emergencies, you will receive a 100% refund.

3. REVISIONS & FEEDBACK

✦ Progress Updates:
I will provide feedback and show updates at every major stage of the artwork.


✦ Sketch Stage:
You get up to 3 rounds of major revisions (changes to pose, anatomy, hairstyle, clothing layout) for free during the sketch phase.


✦ Post-Approval Changes:
Once the sketch is approved, no major revisions are allowed for free. Any major structural changes requested after this stage will incur an additional fee ranging from +20% to +100% of the base price, depending on the complexity.


✦ Minor Changes:
Small adjustments (tweaking colors, minor details, lighting fixes) are allowed at any stage of construction free of charge.

4. COPYRIGHT & USAGE RIGHTS

✦ Personal Use Only (Standard Price):
- The artwork is strictly for your personal, non-commercial use (only social media post, avatars, banners and wallpapers are allowed).
- You are not allowed to claim authorship of the art.
- You are strictly prohibited from using the artwork for AI training, machine learning, or NFTs
- When posting the artwork publicly, you must credit me by using my nickname (AKIGANE) or linking back to my social media handles. (does not apply to banners and avatars, but appreciated)


✦ Commercial Use (+100% Fee):
- If you intend to use the art for profit (Merch production, prints, monetization), +100% commercial fee will be added to the base price.
- With commercial rights, artist credit is appreciated but optional.


✦ Publicity & NDA:
- As the artist, I reserve the right to post any commissioned artwork to my social media portfolios (Twitter/X, DeviantArt, etc.).
- If you want your commission to remain fully private (NDA/Private Order), +20% privacy fee will be applied.

5. COMMUNICATION & GHOSTING POLICY

✦ Communication:
Smooth workflow requires active feedback.


✦ Official Channels: All official communication, updates, and feedback must take place via Discord DM or X (Twitter) DM.


✦ Ghosting Rule:
- If you fail to respond to my messages/updates for more than 3 days at any stage of the artwork, the project deadline will be frozen at the exact moment the last update was sent.
- Your order will be moved to the back of my queue until communication is restored.

6. I WILL NOT DRAW

✦ I reserve the right to refuse any commission request if I am uncomfortable with the subject matter. I do not draw:


- Extreme Gore / Guro (heavy blood/violence)
- Mecha / Highly Complex Robotics
- Extreme Fetishes (Note: NSFW/Suggestive art is negotiable)
- Hate Speech / Offensive, Discriminatory, or Political content
- Hyper-Realism
